SMS / Text Messaging Privacy Policy

This SMS Privacy Policy describes how Nirvani Company ("Nirvani," "we," "us," or "our") collects, uses, stores, and protects your mobile phone number and SMS opt-in consent. It supplements and incorporates by reference the Nirvani Privacy Policy.

By opting in to receive SMS messages from Nirvani, you acknowledge and agree to the terms of this policy.

4. No Third-Party Sharing for Marketing

Mobile phone numbers and SMS opt-in consent are not shared, sold, rented, or transferred to third parties or affiliates for marketing or promotional purposes — under any circumstances.

Your phone number stays inside Nirvani's systems. We do not include phone numbers in any data feed, lead list, or partnership exchange that could result in third-party marketing contact.

5. Service Providers

We share phone numbers solely with messaging infrastructure providers and telecom carriers strictly for the purpose of delivering the messages you have opted in to receive. These providers act as data processors on our behalf and are contractually prohibited from using your phone number for their own marketing or any purpose other than delivering Nirvani's messages.

Service providers may include cloud messaging APIs (such as Twilio), our CRM and platform infrastructure, customer-support tooling, fraud-prevention services, and analytics services that measure message-delivery health (without exposing your number to third parties for marketing).

We retain your phone number, consent records, and message history for the duration of your relationship with Nirvani plus five (5) years, as required for compliance with the Telephone Consumer Protection Act (TCPA), FCC regulations, mobile-carrier program rules, and our recordkeeping obligations. After this retention period expires, records are deleted or anonymized.

If you opt out, we retain a record of your opt-out (your phone number on a do-not-contact list) for the same retention period so that we do not inadvertently re-contact you.

No system is perfectly secure, and we cannot guarantee absolute security of any information transmitted to or from us.

We may update this SMS Privacy Policy from time to time. We will post the updated policy at this URL with a revised "Last updated" date. For material changes, we will provide notice through the SMS program or through other reasonable means before the change takes effect.
